1. Scope and Applicability

These Terms and Conditions (“Terms”) are a legally binding agreement between you (“Customer” or “you”) and 1000594594 ONTARIO INC., including its affiliates and subsidiaries (collectively, “Triq eSIM”). They govern your access to and use of our products and services delivered through our WhatsApp store and our informational website (the “Services”). These Terms are available at https://esim.triq.com/terms. Variations to these Terms are valid only with explicit written consent from Triq eSIM.

By accessing or using the Services — including initiating a purchase via WhatsApp — you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

Triq eSIM’s Privacy Policy (https://esim.triq.com/privacy) explains how we collect and use personal information.

2. Description of Services

2.1 WhatsApp Store (the only place to browse & buy)

All plan browsing, selection, and purchases occur exclusively in our WhatsApp store. There is no plan catalog, checkout, or account area on the website.

2.2 Website (informational only)

The website exists only to display: Privacy Policy, Terms & Conditions, Refund Policy, and step-by-step instructions/links for starting the purchase flow in WhatsApp. Any plan names, prices, coverage notes, or screenshots shown on the website (if any) are illustrative only and not an offer. If there is any discrepancy, the information presented inside the WhatsApp store prevails.

2.3 Device Compatibility

You are responsible for ensuring your device is eSIM-compatible and network-unlocked. Compatibility may vary by carrier/region. Verify before purchase; refunds for incompatibility are handled per our Refund Policy.

3. Contract Duration and Termination

Your contract with Triq eSIM begins when you confirm a purchase in WhatsApp. Triq eSIM may suspend or terminate access to the Services (including unfulfilled orders) for suspected fraud, abuse, illegal activity, or material breach of these Terms. You may cease use of the Services at any time.

4. Pricing, Payments, and Refunds

4.1 Payments

You agree to pay all fees for selected plans/top-ups using available methods (e.g., credit/debit cards, Apple Pay, Google Pay, Amex) processed by our partner Stripe (and its acquiring partners). Taxes, FX, bank, or issuer charges may apply.

4.2 Refunds

Refunds are granted only under the conditions in our Refund Policy or as posted at https://esim.triq.com/refund. Generally, requests must be submitted within 2 days (48 hours) of purchase with required evidence. The Refund Policy (including eligibility and processing timelines) is incorporated here by reference.

5. Delivery

After payment verification, your eSIM QR code and activation instructions are delivered in the same WhatsApp chat. Typical delivery is 1–3 minutes after verification, but additional checks or network delays may extend delivery time. If you do NOT recieve your eSIM please contact us at help@esim.triq.com.

Parts of the Services rely on third parties (e.g., WhatsApp for messaging, Stripe for payments, carrier/network partners for connectivity). Your use of those services is subject to their terms and policies. Triq eSIM is not responsible for third-party platforms, outages, or actions.

8. Disclaimers and Limitations of Liability

The Services are provided “as is” and “as available” without warranties of any kind. Coverage, speeds, and quality vary by location, network conditions, device, and other factors outside our control. Triq eSIM is not a carrier and is not liable for third-party network performance.

9. Changes to Services and Terms

We may modify or discontinue features (including plan availability, pricing, and payment methods) at any time. We may also update these Terms; the “Last Updated” date reflects the latest version. Updates apply to future purchases and continued use of the Services. Continued use after changes take effect means you accept the updated Terms.
